Tony Lee Wagner Arrested For Assault, Kidnapping and Rape

Investigators from the Fort Scott Police Department recently assisted Missouri Highway Patrol in solving a 30 year old cold case from 1992.
This investigation led to the arrest of Tony Lee Wagner (61) of Fort Scott. Wagner was subsequently booked into the Bourbon County Jail.

Wagner was charged on Oct. 11, 2022 for an assault, kidnapping and forcible rape that happened in the Branson, Missouri area  August 15, 1992, in Henning State Park in Taney County, Missouri.

The Taney County Prosecuting Attorney’s Office filed the following charges against 61-year-old Tony Lee Wagner, of Fort Scott, on October 11, 2022 with two counts of assault first-degree, kidnapping first-degree and forcible rape.

 

  • According to the Missouri State Highway Patrol, “On August 14, 1992, two women traveled from Texas to vacation in the Branson, Missouri, area. On the afternoon of August 15, 1992, both women visited the Henning State Park on Missouri Highway 76 in Taney County to walk on the trails.”

    While they were walking, they encountered an unknown man. Authorities say he started to assault both women.

    The MSHP states, “One of the women was able to escape and summoned help from a passing motorist. Law enforcement officers quickly began a search of the park.”

    Authorities found the second victim in the park in an area away from the original scene. Emergency personnel took both women to area hospitals.

    The Missouri State Highway Patrol states that it and the Taney County Sheriff’s Department immediately launched a joint investigation. They didn’t identify any suspects during the initial investigation and the case went cold.“Continued investigation efforts and advances in forensic science technology led to Wagner being identified as a suspect,” states the Missouri State Highway Patrol.

    Troop D Division of Drug and Crime Control Unit, the Missouri State Highway Patrol Crime Laboratory Division, Fort Scott (Kansas) Police Department, and Parabon Nanolabs worked together to solve the case.

    The Taney County Prosecuting Attorney’s Office charged Wagner on October 11, 2022.

    Fort Scott (Kansas) Police Department officers arrested Wagner. They are holding him without bond in the Bourbon County, Kansas, jail pending extradition to Missouri.

Update on Attempted First Degree Murder in Fort Scott

On Saturday, 9/24/22, at around 4:23 am, Fort Scott Police, along with EMS personnel, responded to an address in the 400 Blk of Andrick, for a report of an adult male that had been discovered laying in the grass with multiple injuries.  The victim has been positively identified as being Kenneth Bevins, 39, of Fort Scott.  Bevins was transported by EMS personnel to a hospital in Kansas City.

 

As of today, October 10, 2022, four (4) subjects have been taken into custody.  Michael Sheriff, (23) of Fort Scott, and Tavin Eisenbrandt (20) of Fort Scott are currently being held at the Bourbon County Jail. Two (2) juveniles are also in custody for the following offenses:

 

1)  Attempted Murder 1st Degree

2)  Aggravated Robbery.

 

All persons are presumed innocent until found otherwise in a court of law.

 

The victim, Mr. Bevins, remains in critical condition.  Our thoughts and prayers go out to him and his family during this difficult time.

The injuries suffered by Bevins are severe.  This incident is under investigation by FSPD.

FS Police Department: Fraudulent Call Reports

Today, Fort Scott Police Department has received numerous reports of an individual making phone calls posing as a member of our department.  During these phone calls, the caller either mentions a subpoena being issued due to a citation, or about a fine that needs to be paid.

 

We want to assure you that these calls are 100% fraudulent, and do not originate from our department or any department member.  No member of our department or municipal court would make phone calls of this nature.

Ft. Scott Robbery Suspect Taken Into Custody

On Tuesday July 12th at approximately 2:30 p.m. Officers with the Fort Scott Police Department were dispatched to west side of Casey’s convenience store. Witnesses reported seeing a white male drop a cash register and then drive north on 69 highway in his vehicle.

At the same time Officers with the Fort Scott Police Department responded to Walgreen’s located at 2229 South Main and learned that a white male entered the store, went behind the counter, and removed the cash register and left the store. Nobody was injured during this incident.

Based on the eyewitness descriptions the Bourbon County Sheriff’s Office located the suspect vehicle near Wagon Road and 69 highway. The vehicle was pursued but the suspect was not apprehended at this time.

Local Law Enforcement Agencies were notified of the pursuit and vehicle description. Vernon County Deputies located the vehicle on the east side of Nevada, Missouri and were able to take the suspect, Lewis A. Stein of St. Charles Missouri, into custody.  Stein is being held in Vernon County Jail on separate charges. Local charges are pending.

 

All suspects are innocent until proven guilty in a court of law.

Deceased Man Is Presumed to Be Derrick Johnson

Yesterday, 6/16/22, the body of a deceased male individual was located in the northern end of Gunn Park, near the  Marmaton River.   The deceased is now presumed to be 40 year old, Derrick Wayne Johnson of Fort Scott.

 

Confirmation of identity as well as cause of death will be determined by an impending autopsy, which is scheduled for Sunday, June 19th, 2022.

 

This investigation is on-going.  Official updates will be released as we are able.

 

Our thoughts and prayers are with the Johnson family.

A Death In Gunn Park is Still Under Investigation

On June 16, 2022 at approximately 10:45 a.m., members of the Fort Scott Fire Department, Fort Scott Police Department, Bourbon County Sheriff’s Office, and EMS responded to a report of a possible deceased individual in the woods at Gunn Park in the west part of the city, according to the FSPD Facebook page.
A deceased individual was subsequently located in the northern end of the park, near the river. The cause of death is currently under investigation. The name of the deceased individual is being withheld until the next of kin can be notified.
“We are currently waiting on the autopsy results to make a positive identification on this person,” said Sergeant Bill Downey FSPD Public Information Officer.
